These Terms of Service ("Terms") govern your use of the tscalesolution.com website and the services provided by Tscale Solution Inc. ("we," "us," or "our"). By accessing or using our services, you agree to be bound by these Terms.
1. SERVICES
Tscale Solution provides digital marketing and web development services including but not limited to:
- Website design and development
- E-commerce development and online stores
- Search engine optimization (SEO)
- Google Ads and YouTube advertising
- Social media marketing and management
- Graphic design and branding
- Photography and video services
- Business registration and setup
- Ongoing website maintenance and support (tscaleCare)
- Custom software development
All prices are listed in Canadian dollars (CAD) and are subject to change without notice. Current pricing can be found on individual service pages. All listed prices are exclusive of GST.
2. PAYMENT TERMS AND CONDITIONS
Payment terms are as follows:
- Website Projects: 50% deposit required before work begins, remaining balance due upon completion
- Monthly Services: Billed monthly in advance
- Annual Services: Full payment required upfront (e.g., tscaleCare Annual: $1,200)
- Late Payments: Services may be suspended after 7 days of non-payment
- Refunds: No refunds for completed work or monthly services already provided
- Additional Fees: Rush projects may incur additional charges
3. CLIENT RESPONSIBILITIES
As a client, you agree to:
- Provide accurate business information and content within 5 business days of request
- Review and approve designs/content within 3 business days
- Provide necessary access to accounts, platforms, and materials
- Ensure you have legal rights to all content and materials provided
- Make payments according to agreed schedules
- Provide feedback in a constructive and timely manner
- Maintain backups of your content and data
Important: Client delays in providing content or approvals may result in project timeline extensions and potential additional charges.
4. INTELLECTUAL PROPERTY RIGHTS
Intellectual property terms:
- Final deliverables become your property upon full payment
- We retain rights to showcase work in our portfolio
- Third-party assets (fonts, images, etc.) remain under their respective licenses
- Final build and design files (source code not included) created for you are transferred upon payment
- Clients may request to opt out of public portfolio display in writing prior to project completion
5. LIMITATION OF LIABILITY AND DISCLAIMERS
Important Limitations:
- Our liability is limited to the amount paid for the specific service
- No guaranteed results for marketing campaigns or SEO rankings
- We are not liable for any indirect, incidental, or consequential damages
- No warranty for third-party services or platforms
- Client is responsible for maintaining backups of their data
- We are not liable for lost revenue, business interruption, or data loss
6. CONFIDENTIALITY AND DATA PROTECTION
We respect the confidentiality of your business information and will not disclose it to third parties without your consent, except as required by law or as necessary to provide our services. We implement reasonable security measures to protect your data.
7. TERMINATION AND CANCELLATION
Termination terms:
- Monthly services: 30 days written notice required
- Annual services: No refunds for early termination
- Project cancellation: Deposit is non-refundable for work already completed
- Breach of terms: Immediate termination possible, including but not limited to misuse of services, non-payment, or abusive behavior toward staff
- Upon termination, you remain responsible for payment of completed work
8. GOVERNING LAW AND DISPUTE RESOLUTION
These Terms are governed by the laws of British Columbia, Canada. Any disputes will be resolved in the courts of British Columbia. We encourage resolution through direct communication before pursuing legal action.
9. CHANGES TO TERMS
We may update these Terms from time to time. Changes will be posted on this page with an updated effective date. Continued use of our services constitutes acceptance of updated terms.
